Over the past six months, two class-action lawsuits alleging price fixing have been filed against prominent ski resort companies, including Vail Resorts, Alterra Mountain Company, which owns Winer Park, and Powdr Corp., which owns Copper Mountain. The most recent class-action lawsuit alleges that these major ski resorts colluded with the industry trade association and data firm, which distributed confidential revenue and pricing information, in an anticompetitive scheme to promote price-fixing practices at destination ski resorts.
The lawsuit further alleges that the distribution and exchange of data enabled the ski resorts to employ a strategy of consolidation, which allows for the unlawful artificial inflation of prices related to destination resort packages. Even though the ski resorts justify the 40% increase in season pass prices and 55% increase in day ticket prices by highlighting the escalating climate crisis and emerging global pandemic, the class action lawsuit argues that such drastic increases demonstrate the suppression of competition in violation of Federal antitrust laws.
